1. Scope

These Terms of Service apply to the use of the SurveySpectrum platform (hereinafter referred to as "Service") by registered users (hereinafter referred to as "Users").

By registering, the User agrees to these Terms of Service. Deviating conditions of the User are not recognized unless we expressly agree to their validity in writing.

2. Service Description

SurveySpectrum is a web-based platform for creating, conducting, and evaluating online surveys. The service includes:

• Creation and management of surveys
• Various question types (Single Choice, Multiple Choice, Scale, Free Text, etc.)
• Participation in public surveys
• Evaluation and analysis of survey results
• Optional time tracking and analytics

3. Registration and User Account

3.1 Registration

Registration is required to use certain features. The User agrees to:

• Provide truthful information during registration
• Keep their access credentials confidential
• Notify us immediately of unauthorized use of their account

3.2 Account Security

The User is responsible for all activities that take place under their account. We recommend enabling two-factor authentication.

4. Usage Rights and Obligations

4.1 Permitted Use

The User receives a non-exclusive, non-transferable right to use the Service for:

• Private purposes
• Business purposes (e.g., customer surveys, employee surveys)
• Scientific research
• Educational purposes

4.2 Prohibited Use

It is prohibited to:

• Use the Service for illegal purposes
• Create surveys with discriminatory, offensive, or illegal content
• Collect personal data without the consent of the data subjects
• Send spam or unwanted mass requests
• Overload or manipulate the technical infrastructure
• Bypass or interfere with security measures
• Perform automated access without prior authorization

5. Content and Copyright

5.1 User Content

The User retains all rights to the content they create (surveys, questions, etc.). By uploading, the User grants us a simple right of use to provide the Service.

5.2 Responsibility

The User is solely responsible for the content they create and guarantees that:

• The content does not violate the rights of third parties
• The content does not violate applicable law
• Required consents have been obtained

6. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy. The User is obligated to comply with applicable data protection regulations when collecting personal data through surveys.

7. Availability

We strive for high availability of the Service but cannot guarantee uninterrupted accessibility. Maintenance work will be announced in advance whenever possible.

8. Liability

8.1 Limitation of Liability

We are liable without limitation for intent and gross negligence. In cases of simple negligence, we are only liable for breach of essential contractual obligations and limited to foreseeable, typical damage.

8.2 Exclusion

We are not liable for:

• Damage caused by user content
• Data loss due to technical disruptions
• Damage caused by unauthorized third-party access
• Indirect damages or lost profits

9. Termination

9.1 Termination by the User

The User can delete their account at any time in the settings. Upon deletion, all associated data will be removed.

9.2 Termination by Us

We reserve the right to suspend or delete user accounts in case of violations of these Terms of Service. In case of serious violations, this may occur without prior warning.

10. Changes to These Terms of Service

We reserve the right to modify these Terms of Service. Changes will be communicated to users. Continued use of the Service after the changes take effect is deemed acceptance.

11. Final Provisions

11.1 Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 Severability Clause

Should individual provisions of these Terms of Service be invalid, the validity of the remaining provisions remains unaffected.

11.3 Jurisdiction
